Terms of Service

Effective: March 17, 2026

1. Acceptance

By using TitanOcta software, services, or infrastructure ("the Platform"), you agree to these Terms. If you do not agree, do not use the Platform.

2. What TitanOcta Is

TitanOcta is local-first AI infrastructure. You run agents on your hardware. We provide the routing engine, agent framework, and optional cloud fallback services. Your prompts, session data, and memory stay on your machine unless you explicitly configure otherwise.

All tiers require submission of hardware and performance telemetry. This includes:

This data feeds the community benchmark layer and Grafana dashboards. We never collect prompts, session content, API keys, or agent memory data. See our Telemetry Disclosure for full details.

5. Acceptable Use

You agree to use TitanOcta only for lawful purposes and in compliance with our Acceptable Use Policy. We reserve the right to suspend access for violations.

8. Service Availability

Local functionality runs on your hardware and is not dependent on our servers. Cloud fallback services are provided on a best-effort basis. We do not guarantee uptime for cloud routing or hosted services.

9. Limitation of Liability

TitanOcta is provided "as is." We are not liable for data loss, downtime, hardware damage, or any indirect damages arising from use of the Platform. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

You can stop using TitanOcta at any time. We can terminate or suspend your access for violation of these Terms or the Acceptable Use Policy. On termination, your local data remains yours — we do not have access to it.

11. Changes to These Terms

We may update these Terms. Material changes will be communicated through the Platform or via email. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Disputes will be resolved in the courts of Florida.
